Information On The Processing Of Personal Data
As Aksa Akrilik Kimya Sanayi A.Ş. (“Aksa Akrilik”), one of our primary principles is the protection of fundamental rights and freedoms, including privacy, ensuring information security, and respecting ethical values. In accordance with the Personal Data Protection Law No. 6698 (“KVKK”), our Company, acting as the Data Controller, provides the following explanations regarding the processing and protection of your personal data and special category personal data in order to fulfill its obligation to inform as stipulated in Article 10 of the KVKK. The term "personal data" used in this document includes special category personal data.
Purpose of Processing and Transferring Personal Data
Your personal data are collected and processed by our Company, in physical or electronic form, for the purposes of enabling the exercise of your rights related to the shares you hold in Aksa Akrilik, fulfilling the obligations arising from shareholding, ensuring compliance with the legal regulations under the Turkish Commercial Code, Capital Markets Law and other relevant legislation, carrying out our company general assembly processes and electronic general assembly processes in accordance with the procedures, establishing communication, ensuring the security of legal and commercial transactions, providing necessary process controls within the scope of risk management activities, conducting necessary IT operations to ensure transaction security, addressing your requests, opinions and complaints, managing processes before public institutions and organizations such as the Capital Markets Board, Borsa Istanbul A.Ş., and Central Securities Depository A.Ş. (“MKK”) within the following personal data categories:
Identity Information (name and surname, Turkish ID card, passport or driver's license and the information contained in these documents)
Contact Information (phone number, address and residence, email address)
Legal Transaction Information (your signature, etc.)
Financial Information (payments made in relation to shareholding in the company, etc.)
Other Information (other personal data arising from shareholding).
Your personal data may be transferred to service providers (e.g., authorized persons and institutions for the use of the MKK Electronic General Assembly System during general assembly processes), intermediary institutions, our business partners, public and/or private legal entities such as the Capital Markets Board, Borsa Istanbul A.Ş., as permitted by legislation and to the extent necessary within the above-mentioned purposes.
In addition, in order to fulfill our legal obligations or company policies, internal audit, risk management and reporting obligations, and to achieve the above-mentioned purposes, your personal data may be shared with Akkök Holding and Akkök Holding group companies operating in Turkey, as well as with lawyers, notaries, auditors, and consultants when necessary to defend our rights and interests, and with other relevant official institutions and organizations. However, we would like to emphasize that we do not engage in any personal data sharing activities in violation of any legislation.
Method and Legal Basis of Collecting Personal Data
Personal data are collected, used, recorded, stored, and processed by our Company in accordance with the principles of legality and fairness, by providing clear and understandable verbal and written information to the personal data owners and obtaining their explicit consent, in connection with and limited to the legitimate purposes explicitly stated above, and in accordance with the principle of proportionality.
Your personal data are processed within the following legal grounds specified in Article 5/2 of the KVKK:
a) Clearly stipulated by laws,
b) Required for the establishment or performance of a contract, provided that it is directly related to the contract to which the data subject is a party,
c) Mandatory for the data controller to fulfill its legal obligation,
d) Required for the establishment, exercise or protection of a right,
e) Necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
